DVWCT Claim Prevention and Legal Update

Open to DVWCT Members at no cost.

The Delaware Valley Workers’ Compensation Trust (DVWCT) is pleased to host this informative annual workshop. This year’s program focuses on the challenges of a compensable claim and the malingering injured employee as well as case studies on successful law enforcement officer physical fitness initiatives and a “teaser” preview for a new Safety Leadership Training for managers and supervisors. A detailed agenda follows.

We encourage DVWCT Risk Control Contacts, Managers, Police Chiefs and Command Staff as well as Department Heads and emerging Local Government Leadership to attend. A light breakfast and lunch will be provided.

9:00 a.m.         Welcome and Introductions

9:05 a.m.         How to Overcome Challenges of the Malingering Injured Employee  The compensable claim is one where facts confirm how the injury occurred, confirmation of diagnoses, and expected disability time frames. Our speakers will discuss the engagement of the employer to stop the malingering employee and identify potential red flags including: “doctor shopping”, adding body parts to complaints, and non–compliance with orders from superiors when return to work has been ordered. This session will provide the anatomy of a winning case and the potential consequences for failure to return to work.

Presenters: Patrick Molloy, Chief of Police, Abington Township and Anthony Natale, Esq., Marshall, Dennehey, Warner, Coleman & Goggin

10:15 a.m.       Break

10:30 a.m.      Successful Law Enforcement Officer Physical Fitness Initiatives  The International Association of Chiefs of Police facilitated a multi-agency study in 2012 that showed physically fit police officers were less likely to suffer a work-related injury.  Additionally, overweight officers were more likely to sustain serious injuries, miss more days from work when injured and require more rehabilitation. Unfortunately, encouraging employees who work 12-16 hours per day to exercise is challenging. In this segment, two member chiefs of police will discuss how they overcame institutional obstacles and were able to significantly improve physical fitness levels in their respective departments.

Presenters:  David Scirrotto, Chief of Police, Lower Moreland Township; Patrick Molloy, Chief of Police, Abington Township

11:30 a.m.       Safety Leadership Training for Managers and Supervisors   As with many aspects of workplace culture, those in charge can make or break an organization’s safety program. To answer the age-old question, “What can I do as a leader to keep my employees and volunteers safe?” the DVT Risk Control Department has compiled a new seminar which conveys the essential skills required for supervisors/managers to become safety leaders. In this segment we will provide a 45-minute preview of this compelling topic and highlight some of the powerful prevention skills covered in more depth during the full, half-day workshop.

Presenter: Michael Pacana, Sr. Risk Control Consultant, Delaware Valley Trusts
